Treatment of Malignant Tumors with Radiation and Criminal Liability for them in Iraqi Law

Abstract
The use of nuclear energy is now commonly used in many fields. Some which are used in fields that benefit humanity ( in time of peace), whereas some are used in areas that are harmed, such as its use in weapons (in time of war). Among the uses that serve humanity on a large scale is its use in the medical fields and the treatment of some diseases, which is called (Ionizing Radiation), which modern science in the field of medicine concludes that it can be used in the treatment of many diseases such as diseases of weak immunity and malignant tumors. Also the use of radioactive isotopes has contributed to the elimination or reduction of these diseases. Most countries have adopted legislation regulating the use of these materials and radiological devices used in medical fields. At the same time preventing them and the dangers of their use. Ionizing radiation may be used in the diagnosis or treatment of disease, this means that it may contribute to the diagnosis of the disease in its initial stages, which helps in its treatment at a high rate. The International Atomic Energy Agency has taken care of this issue and has set the rules governing the use of those radioactive materials and devices used in them and urged countries to abide those rules by issuing internal laws regulating such use of ionizing radioactive materials by obtaining the necessary licenses for institutions and people who are working on them. This is what the Iraqi legislator has done as it issued a law for the prevention of ionizing radiation No. 99 of 1980, which dealt with all aspects of licensing, use, and the effects resulting from the use of such radiation
