Abstract
This study examines the legal framework governing the administration’s payment of financial consideration under government contracts in Iraq, باعتباره one of the most important elements of an administrative contract and a fundamental guarantee for maintaining a balance between the interests of public administration and the rights of its contracting party. The study focuses on clarifying the legal nature of financial consideration, the mechanisms for determining and disbursing it, the administration’s liability for delays in payment, as well as the legal remedies available to the contracting party in cases of breach of this obligation. The study concludes that financial consideration constitutes the cornerstone for ensuring the continuity and stability of government contracts and for maintaining their financial and legal stability, particularly insofar as confidence between the contracting party and the administration is strengthened.
