Administrative Investigation in the Public Service and its Impact on the Protection of Rights and Freedoms

Abstract

The Iraqi law provided several guarantees for the benefit of the employe, including the investigation with him before imposing punishment on him. The administrative investigation is the only legal tool approved by the Discipline Law for State and Public Sector Employees. And it is done by a tripartite committee, provided that one of them has a university degree in law, so the committee works to collect information and evidence,  and the investigations may not lead to the punishment of the employee and his question in all cases, so we questioned in our research what is intended in the procedural guarantees for the employee.
