Pre-and Post-Employee Guarantees on Exclusion Penalty

Abstract
The term exclusion has been frequently touched upon in recent times especially after the events of 2003. There have been many cases of its occurrence due to the situation that Iraq is going through and the spread of administrative corruption in it, as well as the weakness of administrative control in examining the availability of the conditions for appointment in the candidate for public office, in addition to other reasons. The importance of exclusion has increased in all departments of the Iraqi state as a result of the increase in its cases. This was accompanied by a clear confusion in resorting to exclusion from the job, as management may sometimes be resort to it instead of dismissal despite the lack of application of the text on exclusion contained in the text of Article (62) of the amended Civil Service Law No. 24 of 1960, and this has been shown to us through the decisions of the Employees Judiciary Court on exclusion.
