Abstract
The idea of this study focuses on the extent to which the judicial constants of the Federal Court of Cassation are adopted as a primary source of law because Iraq considers the opinions of the judiciary as a secondary source of law, which makes these opinions not fixed and subject to renewal and change, Unlike laws, which are characterized by a large percentage of stability, the more binding the opinions of the judiciary, the more they are characterized by stability and the greater the confidence of individuals in the stability of the positions of the judiciary and not to change them, or replace them and thus protect and guarantee the acquired rights and safeguard the notion of legitimate expectation, a key legal premise. that the judicial institution must adhere to protect, to ensure that individuals gain the confidence of individuals in the law, given the seriousness of this matter and the departure from stereotypes at work, especially in light of the great development that the world has witnessed today in a way that achieves the legal security of individuals without prejudice to their acquired rights
