Abstract

This study explores the future of Islamic legal fatwas in an era of digital modeling of fatwa issuance, beginning with the question of the extent to which algorithms can substitute for the human mufti in deriving Islamic legal rulings, particularly contemporary ones. It adopts a foresight-oriented approach to examine the possibility of a transition from human-issued fatwas to digital fatwas based on strict Sharia-compliant regulations that would confine this technology to the role of an assistant rather than that of a mufti. The study concludes that there is a need to establish government-operated digital platforms and enact legislation governing and regulating how intelligent systems are supplied with reliable and authoritative Islamic legal information, thereby preventing the emergence of digital fatwas detached from the jurisprudence of contemporary reality “fiqh al-waqiʿ”. The study further emphasizes that artificial intelligence applications should remain assistive tools and should not be granted the authority to issue fatwas.
